Chris LeMieux Will be Speaking on Two Panels at the 2020 Critical Issues Summit Hosted by the LAGC
Christopher K. LeMieux will be speaking on two panels at the 2020 Critical Issues Summit hosted by The Associated General Contractors of America (LAGC) in Baton Rouge. The Legal Panel will be on Thursday, February 13, and the second panel entitled “Who Bears Risk Allocation in Design” will take place on Friday, February 14. Riess LeMieux Client Prevails in $50-Plus Million Bid Dispute at Louisiana Supreme Court
On December 10, 2019, the Louisiana Supreme Court made final a ruling in favor of a firm client for the award of the Convention Center Linear Park Project estimated at $50 million. In May 2018, the firm successfully secured the award of the public project after defeating a legal challenge by an unsuccessful bidder at trial. The firm prevailed on both rounds of appeal, concluding with the Supreme Court’s denial of the losing bidder’s supervisory writ application.

Riess LeMieux Obtains Sanctions and Contempt Order
Michael Riess, Jon Forester and Robert Riess of Riess LeMieux successfully obtained sanctions and contempt order in favor of general contractor against City of New Orleans due to the City’s attempt to rebid a previously awarded contract in violation of the Public Works Act.
Restoration of Surety’s Right to Enforce Conditional Payment Clauses on State Projects
A discernible shift has emerged in the last decade in favor of sureties asserting conditional payment clauses as a defense to payment bond claims on state public projects. For more than a half-century, state and federal courts almost universally ruled that a surety could not enforce its principal’s pay-if-paid or pay-when-paid clause in defense of a claim against the bond. To this day, federal courts continue to neglect traditional suretyship principles in favor of the public policy underlying the Miller Act on federal projects.
