Federal Government Escapes Liability in Class Action Seeking Recovery of Damages Caused by Hurricane Katrina

In St. Bernard Parish Government, et al. v. United States, No. 2016-2301, 2018 WL 1882913 (Fed. Cir. April 20, 2018), the Parish of St. Bernard and property owners in the City of New Orleans filed a class action suit against the federal government under the Tucker Act, 28 U.S.C. § 1491, for an alleged taking of property following Hurricane Katrina.

New Ruling Rejects Gootee Rationale

In a recent ruling in Nu-Lite Electrical Wholesalers v. Axis Construction Group, the Louisiana First Circuit Court of Appeal rejected the Fourth Circuit's reasoning in Gootee and held that a supplier who filed a lien before the notice of acceptance was recorded complied with the Public Works Act.
