In a recent ruling in Nu-Lite Electrical Wholesalers v. Axis Construction Group, the Louisiana First Circuit Court of Appeal rejected the Fourth Circuit’s reasoning in Gootee and held that a supplier who filed a lien before the notice of acceptance was recorded complied with the Public Works Act. The court concluded that the notice and lien recordation provisions of the statute were satisfied because the general contractor and surety had actual notice of the claim within 45 days of acceptance.
