Court rules again for Uptown homeowners in canal construction damage lawsuit against S&WB
In the second trial arising from the New Orleans Uptown drainage project known as the Southeast Louisiana Urban Flood Control Project (“SELA project”), an Orleans Parish Court ruled in favor of 16 homeowners who alleged their homes were damaged by heavy construction activity, including pile driving. Case Update: LeBlanc Marine, L.L.C. v. State of Louisiana
The Louisiana First Circuit Court of Appeal recently issued an opinion in LeBlanc Marine, L.L.C. v. State of Louisiana (2018-CA-434) reiterating the Court’s opinion that, when a public entity issues a bid requirement that is stricter than a similar statutory bidding requirement, the public entity must follow the stricter bid requirement to the extent it does not conflict with the statute.
