Join Riess LeMieux to discuss new developments in the legal landscape regarding contractors seeking defense and indemnity and additional insured insurance coverage. It is customary for construction contracts to contain defense and indemnity provisions as well as requirements that the owner and/or general contractor be named as additional insureds. The Louisiana Anti-Indemnity Act sets forth rules regarding the enforceability of defense and indemnity and additional insured obligations. Tune in to learn about emerging case law from both Louisiana state and federal courts holding that some defense and indemnity and additional insured provisions in construction contracts are unenforceable if certain requirements are not met.

During this session, we will discuss the impacts to additional insured coverage and defense and indemnity obligations under the recent cases of Salathe v. Parish of Jefferson from the Louisiana Fifth Circuit as well as Atlantic Specialty Insurance Co. v. Phillips 66 Co. from the United States District Court for the Eastern District of Louisiana. In both cases, the Court held that evidence that the indemnitor recovered costs of the required insurance coverage was critical to avoid nullifying the defense and indemnity provisions of the construction contract. In addition to the recent legal landscape, we will discuss specific contract language to watch out for and ways to use your contract to protect your status as an additional insured when an issue arises.
